Drone Regulations

The Ministry of Civil Aviation, on August 27, 2018 released its regulations for drones (“Regulations”) to be effective from December 01, 2018. The Regulations aim to allow for the safe, commercial use of drones in India. One of the most noteworthy introductions in the Regulations is an all-digital platform, called ‘Digital Sky Platform’ which will be utilized for management of traffic through a ‘no permissions, no takeoff’ system.

Madras HC on Defensive Registration of Trademark

The Madras High Court, on June 13 2018, in the case of M/S.N.Ranga Rao & Sons vs M/S.Shree Balaji Associates reiterated the position present in Section 47 under the Trade and Merchandise Marks Act, 1958 for the defensive registration of trademarks. The purpose of filing a defensive application is to reduce the possibility of other traders using the trade mark for unrelated goods or services.

The Madras High Court held that the following conditions must be satisfied in order to successfully execute defensive registration of a trademark. They are: (a) The trade mark should consist of invented words; and (b) the trade mark should have become so well-known with respect to the good it is registered with that the use of the mark in relation to other goods will indicate a connection between these goods and a person entitled to use the trade mark in relation to the first mentioned goods.
