Continuing with our #casecrunch series on landmark judgments that shaped the Insolvency and Bankruptcy Code, 2016 (“IBC“) in 2018, in this post, we discuss the case of Randhiraj Thakur vs. Jindal Saxena Financial Services Private Ltd, where the National Company Law Appellate Tribunal ruled that an insolvency petition under the IBC cannot be initiated against an entity that has not been covered under the definition of a corporate person under the IBC.
